Risks with using third party organisations

There are risks with using third party services for overseas surrogacy arrangements.

The Australian Government does not encourage Australians to engage with third party organisations in Australia or overseas that facilitate or promote overseas surrogacy.

 

There is significant risk in using the services of third-party organisations. In particular:

  • Participating in commercial overseas surrogacy is illegal in some states and territories in Australia.
  • Laws can change quickly in countries regarding the legality of surrogacy.
  • These services may demand payment or make promises without delivering on services.
  • These services may receive commissions from overseas organisations and clinics.
  • It can be difficult to be sure that the international surrogate received proper care before, during and after their pregnancy and that they were not coerced or exploited by third parties.

There is no guarantee that these organisations are acting in the best interests of the parents, the child or surrogate.

If you are considering surrogacy, it is important that you seek independent legal advice.

It is legally safer and in the best interests of the child and parents to pursue altruistic surrogacy in Australia.
