Different Commonwealth, state and territory government departments and agencies have responsibility for different aspects of surrogacy in Australia. Please see below a list of who to contact, depending on what your concern or query relates to.

What is your query about?

  • Passport policy, including as it relates to international surrogacy, is the responsibility of the Department of Foreign Affairs and Trade (DFAT). If you have queries about passports, contact DFAT at Australian Government Department of Foreign Affairs and Trade (dfat.gov.au).
  • Urgent help overseas: If you're an Australian citizen and you have serious concerns about your welfare or that of another Australian overseas, contact DFAT's consular services at Australian Government Department of Foreign Affairs and Trade (dfat.gov.au).
  • Citizenship and visa policy, including as it relates to international surrogacy, is the responsibility of the Department of Home Affairs. For further information, see International surrogacy arrangements (homeaffairs.gov.au).
  • Regulation of surrogacy in Australia and transfers of parentage is the responsibility of state and territory governments. See our page 'Surrogacy in Australia' to find out who to contact in your state or territory if you have queries about the regulation of surrogacy.
  • Surrogacy and parental responsibility or parentage under the Family Law Act 1975 (Cth), is the responsibility of the Attorney-General's Department. If you have queries about the Family Law Act, contact AGD at Attorney-General's Department (ag.gov.au).
  • Medical information regarding surrogacy can be found at Pregnancy Birth and Baby, Australia's leading pregnancy and baby website. Pregnancy, Birth and Baby is funded by the Australian Government and operated by Healthdirect Australia.

To look after your own or someone else's wellbeing, you can contact one of the following services:

  • Lifeline 13 11 14 is a national charity providing all Australians experiencing a personal crisis with access to 24-hour support and suicide prevention services.
  • Beyond Blue 1300 22 4636 provides information and support to help everyone in Australia achieve their best possible mental health, whatever their age and wherever they live.
  • Mensline 1300 78 99 78 is a national telephone and online support, information and referral service for men with family, relationship, and mental health concerns.
  • Qlife 1800 184 527 an anonymous, no-cost LGBTIQ+ peer support and referral for people wanting to talk about sexuality, identity, gender, bodies, feelings or relationships.
  • Red Nose Grief and Loss Support Line 1300 308 307 provides support to anyone affected by pregnancy loss, stillbirth, baby or child death, via their 24/7 Grief and Loss Support Line.
